The German Supreme Court clarifies in his judgement as of 25th of July 2019 (I ZR 29/18) that a trademark owner can object to the usage of his trademark in an advertisment of a Google search, if the advertisment is misleading based on its particular layout and customers are lead to products of third parties (ORTLIEB II) due to the misleading advertising effect of said layout. The lawful owner of the trademark prevailed.
